Terms of service

Pre-launch draft. Final attorney-reviewed terms land before public launch. Reading these gives you the spirit of the agreement; the letter follows.

The big one: we're not your lawyer.

XOsign is an information platform. We surface what the law typically requires, what most contracts include, and where common disputes happen. We do not:

  • Provide legal advice for your specific situation
  • Decide whether a clause is enforceable
  • Represent you in disputes
  • Guarantee a contract holds up in court

When the stakes are high, consult an attorney. We'll even help you send a read-only copy of the contract to one — free, with the “Send to attorney” button in the signer experience.

What you can use the service for

Generate, send, sign, audit, and store contracts and related documents (change orders, pay applications, lien waivers, NTOs, COIs, etc.) related to your business. Use the AI features to extract data from your own documents or documents your counterparty has shared with you.

What you can't use the service for

  • Anything illegal in your jurisdiction
  • Documents you don't own or have permission to process
  • Impersonating someone else as the sender or signer
  • Reverse-engineering or scraping the platform

Your content stays yours

You retain all rights to documents you create or upload. You grant XOsign a limited license to host, process (for the features you invoke), and display them as part of operating the service. We do not train models on your data.

Text messages (SMS)

XOsign sends transactional text messages through our messaging provider, Telnyx. XOsign is the sender of record for every text; we never send on a third party's behalf, and we never send marketing texts. There are two cases:

Account notifications. When you add your mobile number and check the SMS opt-in box at sign-up (or later in Settings), you agree to receive account and document notifications by text — for example signing reminders, completed-signature confirmations, and security codes. This is optional and is never required to create or use an account. Message frequency varies; message and data rates may apply. Reply HELP for help or STOP to unsubscribe.

Document delivery. You can also choose to deliver a document to a recipient by text. When you enter a recipient's number, you authorize XOsign to send them a transactional signature request and a link to open the document.

  • If you enter someone else's number, you confirm you have their consent to be contacted by text about that document. You — not XOsign — are responsible for that consent.
  • Messages are transactional, not marketing. Message frequency varies with how many documents you send. Message and data rates may apply, depending on the recipient's mobile plan.
  • Recipients can opt out anytime by replying STOP; replying HELP returns help info. After opting out, that number stops receiving texts — you'll need to reach them another way (e.g. email or a copied link).
  • Mobile carriers are not liable for delayed or undelivered messages.

Billing

Free tier requires no payment. Paid tiers are charged monthly or annually via Stripe. You can cancel anytime; you keep access through the end of the billing period. Failed charges drop you to Free; your data remains intact.

No warranties, limited liability

XOsign is provided as is. We don't warrant that the service will be uninterrupted, error-free, or fit for any particular legal purpose. Our maximum liability for any claim is limited to the fees you paid us in the 12 months preceding the claim.

If we disagree

Florida law applies. Disputes go to the state courts of Palm Beach County, Florida. You give up the right to a jury trial and the right to participate in a class action.
