Consent to electronic records and signatures

Why you're seeing this

Under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. §§ 7001-7006) and the Uniform Electronic Transactions Act (UETA, e.g. Fla. Stat. § 668.50), electronic records and signatures carry the same legal effect as paper-and-ink ones — but only when you consent to do business electronically. This page is that disclosure.

Your consent to electronic records and signatures

By signing, sending, or completing a document through XOsign, you agree that:

  • Your electronic signature is legally binding and has the same force as a handwritten one
  • Contracts, disclosures, notices, and other records related to your transaction may be provided to you electronically rather than on paper
  • The audit trail XOsign records — timestamps, IP addresses, geolocation, device information, and authentication method — may be used to attribute the signature to you

Hardware and software you'll need

To access and retain electronic records through XOsign, you need:

  • A current web browser (recent versions of Chrome, Safari, Firefox, or Edge) with cookies and JavaScript enabled
  • A device — computer, tablet, or smartphone — with internet access
  • A valid email address (and, where applicable, a mobile number for SMS-based verification)
  • Software capable of viewing and saving PDF files, plus sufficient storage or a printer if you want a local copy

If our hardware or software requirements change in a way that creates a material risk you won't be able to access or retain your records, we'll notify you and give you the chance to withdraw your consent without penalty.

Your right to withdraw consent

You may withdraw your consent to do business electronically at any time, before signing. To withdraw consent, do not complete the electronic signing flow and contact the party who sent you the document, or email support@xosign.ai. Withdrawing consent means the document can't be completed electronically through XOsign; you and the sender would need to arrange an alternative (such as a paper signature). Withdrawal applies going forward and does not affect the legal validity of documents you already signed electronically.

Requesting paper copies

You can download and save a PDF of any document you sign at the time of signing. If you'd like a paper copy of a document or disclosure, email support@xosign.ai from the address on your account. We may charge a reasonable fee to cover printing and postage, disclosed before we fulfill the request.

Keeping your contact information current

Because we deliver records electronically, it's important we can reach you. Keep your email address and mobile number up to date in Settings → Account, or email support@xosign.ai to update them. Signers who don't have an account can update their contact details with the party who sent the document.
